Exhaust ticket! Need help!! Any ideas?

So, I've had my exhaust on my car since 4/2009. I have a 2.5" TruBendz exhaust with a high-flow cat, a Magnaflow muffler, AND an 18" Magnaflow resonator, along with a long tube header. For 3 years, no cop has EVER said ANYTHING about my exhaust -- nor the guys at the emissions check station. I want the performance gains of an aftermarket system but not the ridiculous noise -- my car has a deep tone, but not an overly loud one, especially compared to a lot of ricer Civics and such. Nor is it burpy or farty -- I hate the typical sound of an aftermarket exhaust.

Now, Arizona apparently has a rather arbitrary exhaust noise law -- there used to be an actual noise limit, apparently, but now, the law reads that every car must have a working muffler that prevents "excessively loud or unusual" exhaust noise. So -- it's basically up to the cop to determine what's legal or not.

I got pulled over in either late April or early May by a DPS (Arizona Highway Patrol) officer. It was about 8:30AM on a Saturday morning, and I wasn't actually on a state highway (nor was it through a quiet neighborhood or anything like that). The guy walks up and says, "what's wrong with your muffler"? I said, "nothing", then explained that it's an aftermarket exhaust. I tell him that I actually get better gas mileage with it, and he says, "No way. C'mon. Really?" and I said "Yes, I actually tested about 1 MPG better after." He then tells me that there's an exhaust law in Arizona, and he thinks there's a new one in Pima County (where Tucson is, and I live) and that I'm in violation of it -- and then starts writing a ticket. Not a warning, not a fix-it ticket, but an actual ticket. I'm always extremely polite to cops, and this time was no exception. He had me rev my car, and then said, "Yeah, this is waay too loud. You hear all those cars driving by? That's what your exhaust is supposed to sound like." I ask him how long this law's been around, again, politely, and he says, "decades", and I point out that I've never been pulled over for this by any officer before, to which he says, "Well, I enforce the law." (Emphasis his) He also mentions that he knows from his 'experience as an exhaust tech', or words very similar to that, that aftermarket mufflers are just a waste of money invented by companies to take advantage of young men. He also brags that he often pulls people over for exhaust, including 'one guy out in Marana three times, who just didn't learn his lesson.'

The cop mentions that "if you get this fixed, sometimes the judge won't fine you", and tells me to go buy an "exhaust silencer" to slip inside my exhaust tip. I say to him, "do you mean a resonator? Because I have a resonator on there?" He seems extremely confused, but he says, no, an exhaust silencer.

My court date is this Friday.

First of all, with an 18" res already on there, will a "silencer" (something I'd never heard of before this) even do anything? Second of all, won't this kill my exhaust gains? Third, anyone have any other ideas on how to get out of this ticket? I have a noise-measuring microphone with which I plan on measuring several cars to see just how out of whack my exhaust is, and maybe film it to show the judge. Maybe also take a picture of the resonator to show that I already cared about keeping down my exhaust noise. I don't necessarily disagree with the law, just with this particular enforcement of it -- this guy sounds like he's just pulling over any and everyone with an aftermarket system. If the law was meant to ban aftermarket exhaust systems, it should be written that way. (Or like California's) I'm kinda tempted to just pay the ticket and do nothing, hoping not to run into the same cop.

I like fourth of all!!! haha but i wish i could help you man but we don't have those problems in pa. I had my exhaust cut off on my svt behind the stock resonator for a while and never got problem and it was like drag car honda loud.

I've driven with an open long tube header before (no system connected -- only for a very short period of time, out of necessity) and THAT was loud -- and I didn't get pulled over. SOHCTUNER had an open header on his car for a few weeks or months and never got pulled over. As far as I can tell, the law hasn't changed since then. (2009)

Just pay the fine and keep driving. Sounds like you got pulled over by a cop that just hates loud cars and likely just a general ass judging by what you said i your post.

Your kinda screwed man. Per AZ law as soon as a vehicle has been modded from it's STOCK look, feel, or sound then it is against the law. The only thing I can say is take it to court and say look my exhaust has more "quieting" equipment on the system then a stock vehicle does. The only thing that may screw you over is if he asks to look at your exhaust system and he REALLY does know vehicles and the laws behind them and sees your header. If its a shortie they ok but if it's a LTH then your screwed because those are not street legal... it's a 50-50 shot on if the judge is in a good mood. Good luck

I don't think that's necessarily true, though the fact that the law bans "unusual" exhaust sound seems like it might be interpreted that way. That's certainly what the cop was trying to tell me -- but that's ****ing ridiculous. That's like vaguely banning "devices that portray moving pictures", but leaving all the television shops open.

I'm about 90% sure the judge isn't going to ask to take a look at my exhaust system without me prompting him (by showing a picture of the resonator, etc.). But the judge isn't going to necessarily know offhand that a race header on a Zetec is illegal -- after all, the SVTF has a long tube header. And my car has a cat on it, legally replaced because the OEM one burned out. (Derp derp shorty header derp) I dunno what to do, because you never can tell whether the judge will be sympathetic and recognize that I genuinely try to keep my noise down, and this was a stupid ticket, or that I'm just a lawbreaking ricer moron who needs to be put in my place.

I have no idea how much the ticket will be. A technician yesterday thought it'd be over $100, but I dunno.

I got one of these on my accord when I was a kid. The law was measured in db I want to say it was 95 I went to the place that put my exhaust on and they did a db test with a print out I took it to the police station and they dropped it.

Sounds like the law is vauge and you don't have that option but do you know how loud it is in decibels? Then you could offer some comparison if your going to fight it; my car is as loud as a lawn mower etc.
Yeah, the California limit is 95, but Arizona doesn't have a specific limit anymore; it's just arbitrary. I tested my sound level today at work. From about a foot away from my tailpipe, at 2000 RPM, I was around 83 dB. Now, I didn't get to 3500/4000, so I dunno how loud it'd be higher in the powerband.

I was thinking of measuring my car on video, then some other cars and the forklift we use at work.

Hopefully there is a decibel level attached to the law... you can get it tested and keep the printout with you to show future a**bags. If not, then I agree with bringer, just drive on... a silencer is an insert, like they have on bikes, that fits in the end of the system and damps the noise, but IIRC, I believe it also restricts air flow a bit.
Yeah, no. I also read it makes your exhaust sound terrible. :thumbdown:

Maybe I should just replace every inch of my exhaust with welded Cherry Bombs. Bet THAT would sound good... :mad:

not to rain on your parade, but your exhaust isnt legal on a federal level, much less a state level.

your cat has been moved from its original location, therefore illegal. no matter if your stock cat "burnt out".




as for the noise, the cop was just being an asshat, if you can prove your exhaust is reasonable (ie: an official dB test) you should be fine...

On my svt I have just put on a Trubenz with Borla and 18in Magnaflow resonator along with the C-F-M off road pipe. I have not had any issues so far its only been two weeks but I doubt I will have any problems. If they do I will just ask why they don't pull over Harleys that ride by with straight pipes on all the time. Yours can't be that loud I feel that all states should have a decibel law.

I lived in Yuma for 4 years and had racing header and 2.25" FS exhaust with no stealth piece and never once got pulled over for it.
Moved to Idaho and get pulled over twice for excessive noise. I asked the officer why he doesn't pull over ever single Harley who was 2x louder than me and he said it was because "thats stock".
