Mark Mitsubishi in AZ NOT honoring EBAY auction

Check this out. This is on car and driver's forum.

This dealer's not going to abide by his winning bid, the internet sales manager was "too busy" to hit the auction cancel button.


If I still lived in Phoenix, I would never buy from this dealer.

Mark Mitsubishi in Scottsdale AZ makes me ashamed to be a "Mark".

I was the legimate winner of an ebay auction Thursday night (http://cgi.ebay.com/ebaymotors/ws/eBayISAPI.dll?ViewItem&item=2438028950) for a Evo. I've been in the market for a STi or an Evo. Each has their strengths and weaknesses. A primary attraction for this car was the final $26200 e-bay price for an untitiled car. I own a 1997 Miata with a few mods.

Josh Jones at Mark Mitsubishi in Scottsdale AZ emailed me after the auction had ended and informed me that the car had been sold to an autobroker for a greater amount. The auction did not end early and was not cancelled.

Mark Mitsubishi in Scottsdale AZ apparently was awarded Mitsubishi's Diamond Chapter of Excellence. If Mitsubishi awards this dealer Diamond status, I do not know if I could ever recommend a Mitsubishi product to anyone.

I called Mark Mitsubishi late Friday afternoon because Mark Mitsubishi never contacted me via any method, despite several e-mails on my part requesting same.

I spoke with Josh Jones, the internet sales manager. Mr. Jones was fairly professional in demeanor giving the circumstances.

He informed me that he would not sell the e-bay car to me at the auction price because it was worth far more than that. He said the car was already sold to another buyer. He said he was a "business man" and got a better offer so he took it. I informed him that he was in violation of e-bay rules. He told ME to read the fine print which allowed his actions. I told him he was under certain contractual obligations when he places an item on e-bay and he did not comply with them. He also said he was very busy and did not get a chance to cancel the auction after receiving this alleged better offer. He informed me the car was "gone" or "sold" and asked what I wanted him to do.

Mr. Jones said he was not going to sell me the car because I threaten him and then mentioned a letter of complaint I had send to Mitsubishi Motors NA. I never threatened anyone at any time - I did however file formal complaints with the Better Business Bureau, e-bay.com, and Mitsubishi Motor NA. I forwarded copies of same to Mr. Jones.

I told him I thought I should be the legitimate winner. He told me to give him negative feedback on e-bay.

I asked if he was refusing to take my deposit on the e-bay car. He said he was refusing the deposit.

The call ended.

I called the dealership the evening of the auction aproximately 1 hour or less before the auction closed. The salesman who I talked to did not mention the red e-bay car with leather and DVD was sold.

I'm not sure but my brother is probably ashamed to be "Scott" for fear on having some connection to Mark Mitsubishi in SCOTTsdale AZ.

Personally, I wouldn't want the car with that nasty red/silver leather combo.

However, the dealership is pathetic in my opinion. If they didn't want to sell the car for a low price, then they should have had a Reserve on their auction. Someone who is local should roll by and see if this car is really gone.

Even better, go by there and start looking at one of the Evos then when the sales people try to pitch, you say "Oh, no I'd never buy it from you guys... I was just looking, I heard how your Internet Sales guy [censored] some guy by backing out of a completed eBay auction for an Evo..."

I'd certainly do it if I live near there, I'd love to see the guys face... cuz he'll prolly tell the internet sales guy who will then realize that it is going around that they are irreputable.

So did you call the NA division of Mits? Or just e-mail them? I'd try calling them, you'll be able to get a better response out of them.

Oh well, its probably all for the better. I know I wouldn't want to buy a car that is rusting after 2 months off the dealer lot and has the dealer spying on you if and when it goes to the racetrack.

Can't one do soemthign about it since it says on Ebay it's a contract?

I don't blame you one bit for being angry Mark.It seems that the old bait and switch and deceptive dealer practices are now invading the internet as well.Seems like you contacted the right people to lodge a formal complaint against Mark Mitsubishi but I don't know what the outcome will be if any.Anyway I hope that you find the right car at the right price.

I dealt with them once, they wouldn't cut me a deal on a 97 Eclipse GS-T. They offered me 2 grand less for my trade than everyone else offered.

They do suck, in fact I'd let EVERYONE know about this.

Over the summer when I was purchasing a car, I had a similar experience.

I was at a Honda dealership looking to purchase an Si (2000ish, not new). I went in the middle of the day and discussed with one seller. Wasn't really thrilled with the guy or his negociating skills, so I went back later in the day when he was off his shift. I told the new guy I wasn't happy with the other guy and felt the commission should go to a better person willing to deal with me. The guy understood. We didn't look at the car, just talked in his "office" about the car. I dropped it down to a price with him a price I was willing to pay for the car. It was past 9 and I was car shopping all day, so I told him I would come back in the morning and do all the paperwork (bad bad mistake). I come back in the morning and the manager informs me the wouldn't sell me the car for that price because it was too low and the salesman was dealing without a manager present.



I ended up driving down the road and bought a Focus a few hours later. I didn't want one, but I got a great deal on it

WE RESERVE THE RIGHT TO NOTIFY THE BIDDERS AND CANCEL THIS AUCTION AT ANY TIME!!! They have to notify the bidders that they are cancelling the auction, THEN close it. He wasnt notified, they didnt cancel the auction, therefore, by Ebay rules, the car is his. I have been through this once, with a Euro grill for the ZX3. They cancelled the auction, and didnt notify me. The guy had to go find a euro grill, and sell it to me at the cost of the auction i won. From what I understand, he paid more for it than the price I won it at..

I doubt they actually sold the car, they just didn't want tn take the hit on it. Yep it's pretty crappy way of doing busindss
Remember that thread on the 3000gt a while back? I wonder if this is going to turn into something like that...

At least, since this isn't a private seller, the dealer can get nationwide negative feedback.

I went and checked Mark Mitsubishis's webite, and the car is still for SALE. Same VIN's and everything. For the low internet price of $39999. Sold it to a broker my arse.

P.S.

I was not trying to buy this car. This is someone else's experience, but it really ticked me off.

Has anyone notified the original Ebay buyer of this yet? I have to say that I'm really not surprised.

A guy I work with "stole" a slightly used Lincoln LS from a dealer off Ebay for about $10,000. It was worth considerably more than that, but the dealer still went through with the transaction. It's his wife's car, but he has brought it in a few times and there is nothing wrong with it. It even had a clean "CarFax" report.

i've now read this on about 8 different forums now so it seems like the word is definately spreading.
