Is it legal in california to have people in the back of a bed of a pickup with campershell. Eventough theres no seatbelts in the back?

Im saving up for a campershell like that, Thats the same model truck, but I only have the Regular cab and color is the same but not the year.
 
No. Cali Vehicle Code 23116.

In Cali... all passengers in a vehicle need to have seats... and unless in a bus, or limousine, wearing a seatbelt.

23116. (a) No person driving a pickup truck or a flatbed motortruck on a highway shall transport any person in or on the back of the truck.

(b) No person shall ride in or on the back of a truck or flatbed motortruck being driven on a highway.

(c) Subdivisions (a) and (b) do not apply if the person in the back of the truck is secured with a restraint system. The restraint system shall meet or exceed the federal motor vehicle safety standards published in Sections 571.207, 571.209, and 571.210 of Title 49 of the Code of Federal Regulations.

(d) Subdivisions (a), (b), and (c) do not apply to any person transporting one or more persons in the back of a truck or flatbed motortruck owned by a farmer or rancher, if that vehicle is used exclusively within the boundaries of lands owned or managed by that farmer or rancher, including the incidental use of that vehicle on not more than one mile of highway between one part of the farm or ranch to another part of that farm or ranch.

(e) Subdivisions (a), (b), and (c) do not apply if the person in the back of the truck or the flatbed is being transported in an emergency response situation by a public agency or pursuant to the direction or authority of a public agency.

As used in this subdivision, "emergency response situation" means instances in which necessary measures are needed in order to prevent injury or death to persons or to prevent, confine, or mitigate damage or destruction to property.

(f) Subdivisions (a) and (b) do not apply if the person in the back of the truck or flatbed motortruck is being transported in a parade that is supervised by a law enforcement agency and the speed of the truck while in the parade does not exceed eight miles per hour.
 
When I was in high school several of my friends had trucks with camper shells and I thought nothing of riding back there unrestrained all the time when I'd go somewhere with them. It's kind of funny too, becuase I was always a proponent of seatbelt usage and don't ever ride in a car without one now.

I also had a friend with a CRX and I used to ride in the back of that from time to time. We actually ended up getting stopped and both he and I were issued seatbelt violation tickets for that. (In CA if their is an unbelted passenger in the car, the driver is sighted for allowing this even if they are belted themself).

This happened in the early '90s when the laws still allowed you to ride in the back of a pickup truck so we both went to court to fight our tickets thinking how could I be expected to be wearing a seatbelt if there was no seat. We also wanted an explanation as to why was it perfectly acceptable to do the same thing in a truck without penalty? (What can I say, kids think they know everything :D)

The judge heard our arguments and although he seemed to agree in spirit that there was little difference, he informed us that the laws were different between cars and trucks and we had to pay our $22.00 fine for it. (Yes, I wasted time fighting THE MAN over $22.00 :lol:)

Even a dog in the bed of a truck is supposed to be restrained by a leash now. :screwy:

Do you have the part about dogs riding in there? I think the intent is that dogs riding in open beds have to be restrained - which is only common (uncommon, though) sense. If there is a closed shell, I would think that would satisfy the legal requirement.

I always thought it was legal, as long as it was at least 48 inches high and fully enclosed. Interesting...
 
When I was a kid out in the sticks we all rode around driving 70 on gravel roads in the back of pickups with not even the shell. We did it all the time and didn't think about it. Even a small accident would have sent kids flying in all directions to their deaths.

I should have added the word 'open' to my post as that's what I understand as well. :)

They've got a provision for that actually:
